BVN AIR USA – Limited Factory Warranty 

This Limited Warranty supersedes all prior warranties. 

Unless explicitly stated in writing, no other express or implied warranties—whether statutory or otherwise—shall apply. BVN AIR USA specifically disclaims all implied warranties of merchantability, non-infringement, and fitness for a particular purpose, to the fullest extent permitted by law. 

 

Warranty Coverage 

BVN AIR USA warrants that all equipment sold to authorized distributors is free from defects in material and workmanship for the applicable warranty period listed below. If a factory defect is found, the product must be returned to the distributor from which it was purchased. 

This warranty is non-transferable and applies exclusively to the original purchaser. It does not extend to any subsequent owner or user of the product. 

In cases where the distributor files a warranty claim, BVN AIR USA will repair or replace any part determined to be defective in material or workmanship. Where necessary, the product may need to be returned to BVN AIR USA’s facility along with: 

• A copy of the original bill of sale, 

• A clearly visible Return Materials Authorization (RMA) number on the carton. 

 

Return Requirements 

• An RMA number must be obtained before return. 

• The product must be returned prepaid by the sender. 

• The RMA number must be clearly marked on the external packaging. 

• Failure to follow these conditions may result in the product being refused upon arrival. 

 

Replacement Options 

Once received and validated: 

• The defective product will be repaired or replaced and shipped back to the user. 

• No credit will be issued unless product defect is confirmed after inspection. 

Alternatively, the distributor may place an order for a replacement part or product, which will be invoiced. Credit will be issued only after the defective item is returned prepaid and confirmed defective by BVN AIR USA. 

Any repaired or replaced product is warranted only for the remainder of the original Warranty Period. No extensions or renewals of the warranty shall be granted due to repair or replacement. 

No warranty replacement will be made prior to product inspection. Replacements shipped in advance are subject to invoicing and inspection results. Distributors should not replace defective products for end users without charge, as credit depends on BVN AIR USA’s validation of the defect. 

 

Warranty Limitations & Exclusions 

This warranty shall be considered void and inapplicable under any of the following circumstances: 

• The buyer fails to notify BVN AIR USA in writing of a suspected defect within ten (10) calendar days after discovery or when it should have reasonably been discovered. 

• The product has been subjected to abuse, misuse, neglect, impact, accident, unauthorized modification, repair, or improper installation. 

• The product has been used outside its intended specifications, ratings, or applications as defined by BVN AIR USA documentation. 

• Serial numbers, data labels, or identifying markings have been altered, defaced, or removed. 

• The buyer has not followed installation manuals, operating instructions, or applicable safety and regulatory standards. 

 

This warranty does not cover: 

• Normal wear and tear resulting from regular usage, 

• Cosmetic imperfections that do not affect product performance, 

• Consumable components (e.g., filters, belts, gaskets), 

• Products not sold directly by BVN AIR USA or through authorized distributors, 

• Any costs related to removal, reinstallation, shipping, freight, insurance, handling, or access to the site, 

• Damage caused by external factors including but not limited to acts of God, natural disasters, war, terrorism, riot, or vandalism, 

• Repairs performed without prior written authorization. 

 

Warranty Validation 

End users must retain a copy of their original proof of purchase to validate warranty coverage. These warranties grant specific legal rights and are subject to applicable consumer protection laws. Additional rights may vary by jurisdiction. 

 

Caution Regarding Critical Applications 

BVN AIR USA products are designed for dependable performance, but no product is guaranteed to be entirely defect-free. For use in life-support or safety-critical ventilation systems where failure may cause injury or loss of life, customers must ensure proper system redundancy, backup ventilation, failure alarm systems, and/or risk acceptance protocols are in place.

Note: Filters, plastic housings, brackets, and other accessories not explicitly listed above are covered under a 1-year limited warranty, unless otherwise stated. 

 

Submitting a Warranty Claim 

• Obtain an RMA number from BVN AIR USA or your authorized distributor. 

• Include a copy of your purchase invoice with the returned item. 

• Clearly write the RMA number on the outer packaging. 

• Ship the product prepaid to the specified address. 

Upon verification of defect, BVN AIR USA will repair or replace the item. 

 

Disclaimer of Other Warranties 

This limited warranty is the exclusive warranty offered by BVN AIR USA and is provided in place of all other express or implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, which are expressly disclaimed to the maximum extent permitted by law. 

 

Limitation of Liability 

To the fullest extent permitted by applicable law, BVN AIR USA shall not be liable for any indirect, incidental, punitive, special, exemplary, or consequential damages arising out of or related to the sale, installation, use, or inability to use any BVN AIR USA product, including but not limited to: 

• Loss of profits, savings, or revenue, 

• Business interruption or loss of business opportunity, 

• Loss or corruption of data or production, 

• Loss of use of the product or associated equipment, 

• Cost of substitute equipment, facilities, labor, or services, 

• Damage to property, 

• Bodily injury, illness, permanent disability, or death, 

• Claims by third parties or customers, 

• Professional service costs, such as inspection, diagnostics, or consulting, 

• Legal expenses or penalties, 

• Environmental damage or regulatory non-compliance. 

BVN AIR USA’s total liability, whether in contract, tort (including negligence), strict liability, or otherwise, shall in no case exceed the purchase price actually paid for the specific product giving rise to the claim. 

No representative, agent, contractor, reseller, installer, or third party is authorized to make any warranties, representations, or modifications to this warranty on behalf of BVN AIR USA. 

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, portions of this limitation may not apply. However, all other provisions remain enforceable. 

 

This Limited Warranty is applicable only to products purchased and used in the United States and may be subject to change without prior notice.
